Peter Grand Owner/Editor Inflated News Play & Attractions 2009 got off to a tremendous start with the first Inflated News Play & Attractions Show (INPAS) at Stoneleigh Park Exhibition Centre. This was the first time the Inflated News team had taken on such a massive project and our report on the show, later in this edition, will show those who were unable to attend what a tremendous event they missed. The event was so successful that plans are already underway for INPAS 2010. Inflated News is also currently being expanded. In our March issue we informed readers that Inflated News would become Inflated News Play & Attractions (INPA). We took this decision in January 2009 to reflect the increase circulation of the magazine and to offer a greater coverage of relevant topics for play centres, farm attractions and all play facilities. The UK play industry is very diverse but many of the regulations and interest stories cross many different sectors and our circulation embraces many play sectors. Our circulation is continuing to expand and we are working with many organisations and individuals throughout the different play sectors. We trust that all of our readers will find all of our articles of interest. I welcome all new readers and look forward to receiving your comments. As we grow the additional content means that the number of pages will be increased to ensure that we are able to maintain the high standard set by previous editions. Since its re launch in March 2005 Inflated News has continually expanded and further developments are planned over the coming months. The circulation of Inflated News has increased over the years and now includes a number of different play sectors including indoor play centres, activity centres, theme parks and farm attractions. In January 2009 it was decided to increase the content to cover a wider variety of play issues relevant to the various sectors and to change the name of the magazine to Inflated News Play & Attractions (INPA). It is felt that the new name reflects the true nature of the magazine. Each issue will cover many topics that are relevant to more than one sector but we will also carry articles and information that are specific to the individual sectors. In order that readers can identify these specific topics, the magazine will be divided into various sections that will be easily identifiable by different colour headlines. It is hoped that this will help readers to find relevant topics within their specific play section more easily. We also hope that some of the articles and advertising will prove inspirational to readers and give them ideas for improving their business. We believe that all readers should find some benefit from reading all of the magazine. INPA is offering a number of individuals and organisations within the different play sectors the opportunity to provide articles and information for each issue. If you would like to make a regular contribution to INPA in any of the play and attraction sectors please feel free to contact us and we will happily discuss the opportunities available. Those readers involved in indoor play centres will have regularly received ‘Indoor Play News’ produced by Mike Boyle of Activity World and INPA is pleased to announce that from September 2009 INPA will include this popular news letter. This will be written by Mike and will now include full colour pictures relevant to the articles. Readers who contribute to this news letter should continue to pass content to Mike via his usual channels. INPA is pleased to welcome Mike on board and we look forward to working with him to bring relevant topics to all of our indoor play centre readers. 8 inflatednews.co.uk You will not believe how hard I have found it to work out what to say to welcome you to my column. For those of you in the indoor play industry you will have been receiving my ‘Indoor Play News’ for the past five years , which was my attempt to let off steam. Having operated play areas for 17 years I have seen most of the ups and downs one can experience and we all face the same problems and issues, whether it be annoying customers, difficult staff or just how to increase business. The great thing is for operators to know they are not alone. Previously my newsletter went out to 700 play operators, but in merging with this publication it is now going out to eight times that number, so I recognise that one has to widen the appeal. If you are sad enough you can read my previous newsletters by going to the trade section ofwww.activityworld.co.uk. So what do we have in store for you? Eventually we hope that all the various Trade Associations will have their own page to provide their latest news and we are going to include some specialist columns by experts in their field which should help us all with developing our businesses. Given their popularity in my newsletter, I want to profile a number of different operators of different types of attractions to get their views on the leisure industry. I am not aiming at the big theme parks (although I am happy to include them) but rather the small operator who is actually at the front line facing the day to day issues. I may well be giving someone a call soon to twist their arm but if you would like to volunteer then you can email me atmikeboyle@activityworld.co.uk. I am also looking for any comments or observations which you may have and it can be on any subject so feel free to get in touch. It would be far better to be able to hear your views than just my often depressing ranting. As we continue to face difficult economic times it would be good to hear how you are finding things. The most interesting part of covering an industry which has both indoor and outdoor attractions is that we are almost diametrically opposed when it comes to the weather. The indoor operators want it to rain every day, whilst the outdoor wants the sun to shine ( although not enough to send them all to the beaches). From our perspective the weather remains a much greater influence at the moment than the recession, as irrespective of the economic situation very few visit us in nice weather. It also helps to have a very low priced product. One impact of this recession may be that we will see a dramatic increase in the number of play areas. With the public believing our business is a licence to print money and not requiring a lot of capital to get started, the mixture of lots of redundancy money and an awful lot of empty industrial units with landlords desperate to rent could result in many more leisure attractions opening. There are still plenty of towns and cities which have very limited or no representation, so there is still room for more, but the worry for existing operators will be where new ones appear in an already saturated market. inflatednews.co.uk 9 INDOOR PLAY CENTRE SPONSORS HIPPO Luke Grice, owner of LA Leisure and Run Wild Indoor Play Centre in North Walsham, Norfolk, is always on the look out for ways to promote his business especially if it supports his local community at the same time. His company was approached to sponsor a ‘Hippo’ for a fun event organised to promote North Walsham and surrounding villages. The ‘Hunt The Hippo’ event was organised to coincide with the May half term and 50 Hippos were placed around the Norfolk market town. The idea behind the event was to attract visitors to North Walsham in order that they can see what is on offer and involves locating as many of the Hippos as possible. Rather like a treasure hunt. The original idea came from local businessman Paul East, owner of Divine Bar & Restaurant and Chair of Governors at North Walsham Infants School. Paul said“As well as being a fun week where people can hunt out all the hippos and discover the town, the run-up to it has been just brilliant, with so many children involved and learning so much about Africa, Hippos, art and all sorts of related subjects.” The event concluded on Sunday 31st May with an auction of the Hippos with money raised going to nominated charities. The idea is extremely simple. Get the local businesses to purchase a blank Hippo, get local schools and organisations to decorate them, strategically place them throughout the town, invite the local community and visitors to hunt them down. The cost to organisers, as always, comes down to their time and commitment. Luke told INPA,“ North Walsham being a small market town with shops closing and then the it seemed to be the final straw for the town when Woolworths closed Then came the hippos, local businessman Paul East and Clare Fletcher head teacher of North Walsham Junior school had the idea of a Hippo Hunt (very similar to the elephants in Norwich) to try and promote North Walsham as a town with good shops, cafe's and restaurants etc. As a result various schools and charities have bought a hippo with local businesses sponsoring them. Run Wild a children's indoor play centre andL.A.Leisure a bouncy castle and marquee hire business both owned by me sponsored a Hippo belonging to North Walsham High School and after being displayed on/in local shops etc the Hippos will be auctioned off raising money for various charities. I have got involved because I thought it was a good idea to promote business in the town of North Walsham, Will I buy one at the auction? We will have to wait and see.” If Luke does purchase a Hippo you may well see it at INPAS 2010.
10 inpas.co.uk March 2009 saw the first Inflated News Play & Attractions Show (INPAS) at Stoneleigh Park Exhibition Centre Near Coventry. This new project was the largest event ever attempted by the Inflated News Play and Attractions team and one that they were extremely excited about. The pictures within our report show the true perspective of the event. The first show attracted some 38 exhibitors and show organiser Peter Grand said,” to run our first show in the current climate was a big gamble and I must say a massive thank you to all of our exhibitors for putting on such a tremendous show. The quality and variety of products on display was terrific and the 2009 show has certainly set an extremely high bench mark for future shows.” Our picture right shows the first glimpse of the outdoor display as visitors arrived on site. The outdoor display covered almost 5000 square metres and featured a full range of inflatables including slides, fun runs, bunjee run, human demolition, gladiator joust inflatable stalls/buildings and much more. The indoor area of over 3000 square metres featured yet more inflatables, costumed characters, air dancers, insurers, fabric manufacturers, software, roller racers, archery, sound/lighting, mini marquees and much more. Again the quality of all exhibits was exceptional. Our picture, left, shows the registration area on arrival at the exhibition hall The show was well received by those attending and here’s a couple of emails we received‘I just wanted to thank you for the best bit of advice I have had to date. Having visited and exhibited at the NEC and at Harrogate in the past, INPAS was a huge success and well worth the visit. I came down on Saturday and was completely impressed with every aspect, the response I got from everyone was helpful and friendly from both the exhibitors and the owners of other Rodeo Bull companies, having heard so much from the “ your buying what? “ brigade, it was great to talk to people within the industry that offered encouragement and knowledge, as one owner said “ you’ll fit right in, were all mad here “. ‘just returned from the INPAS show. Its a long time since we have seen bouncy castles and inflatables outside and in my opinion this is where they are best viewed .After registering for the show we headed back outside,in the sunshine so much caught our eye from new concepts to new and improved inflatables, everyone was enthusiastic about there products and rightly so. The atmosphere inside matched the enthusiasm of those outside and it was nice to chat to manufactures and other trade stall holders that are normally knee deep in customers. I heard a lot of positive comments and although the turn out was less than I expected (early Friday pm) those that were there seemed impressed and spending. I would just like to say a big thank you for a very enjoyable afternoon and hope that every one who attended found it the success we did, and look forward to the next one.”Linda Smith - Ace Inflatables - Sussex The weather was extremely kind with the hottest weekend of the year. Whilst this was fantastic for those exhibiting and for the visitors, it did keep some operators away as their telephones had started ringing. 14 inflatednews.co.uk WILLOW’S FARM EXPANDS OFFER AFTER RECORD VISITS Family attraction Willow’s Farm Village is working with Taylor-Made Play to expand its range of family-friendly programmes and facilities. The park, which caters for families with young children, is the first in the country to feature the new range of themed picnic benches from Taylor-Made Play, after seeing the very first model at LIW in September. It has now installed tenof the covered shelters, which have been tailored with a farmyard design of pigs, cows, sheep and goats, to allow visitors to picnic outside whatever the weather. This recent addition comes as the St Albans - based farm announces a 70 per cent increase in visitors following the introduction of an indoor play area, also by Taylor-Made Play. The play area includes a factory-built range of activity modules and three spectacular slides; the most challenging being a vertical free-fall from a scary 7m high, all in a clean and safe environment. The family attraction has seen visitor numbers rise from 290,000 to 492,000 since installing the play area, which has allowed the park to open during the winter months for the very first time. To help cope with the increased numbers, Taylor-Made were back again in the autumn to install Woolly’s Workout, an exciting, outdoor themed agility trail made from sustainably sourced timber, which allows young children to develop their climbing, jumping, swinging and balancing skills in a fun and safe environment. The unique feature of the trail is dual height equipment so that children can challenge their parents and the whole family can join in the fun. “As an outdoor attraction, our business is very much affected by the weather. This new indoor play area has not only attracted 130,000 visitors at a time when we are usually closed, but has also helped to bring in another 70,000 in the main season, who might otherwise be put off from coming to the park because of the weather,”says Andrew Wolfe, Owner of Willow’s Farm Village. The roofed benches, which have been a feature of the Taylor-Made range of outdoor seating for several years, are becoming increasingly popular as people become more conscious of the damage caused by the effects of the sun. “The idea for theming the benches came from our design department and we decided to exhibit one at LIW to test the market. Andrew Wolfe was one of the first customers on the stand and he immediately saw their potential to brighten up otherwise dull picnic areas,”says David Taylor, Managing Director, Taylor-Made Play. Since developing the first few farm-themed benches Taylor-Made has produced zoo benches for outdoor use and party benches for indoors.The latest development is a smokers’ bench, themed with local characters for David’s local pub –“so much better than the canvas awnings that are currently seen as shelters for those that wish to ruin their health,”he says. The Standard states quite clearly that Routine and Annual Inspections are carried out. So in the case of Routine Inspections make sure you have a suitable recording system in place with operators and attendants in place who are trained and capable to carry out this work. For Annual Inspections you can do no better than use an RPII Inspector. The HSE have stated that this represents best practice. The HSE also endorse and encourage the use of the PIPA Scheme in which the rules state only RPII qualified Inspectors can be used. We regularly hire to a local school only this year they have been advised that it is now a legal requirement for all inflatables to have a particular type of safety certificate prior to hire - is this right? Obviously we get it PIPA checked but they're saying this is no longer acceptable. I've never heard of this. Thanks”(Company name supplied) Editors reply: If you have a unit PIPA tested it complies with BS EN 14960:2006 and is considered 'best practice' by HSE. Whilst other tests are acceptable PIPA is regarded as total compliance. If you can get further information from the school as to what it is they think they need and who provided them with the information I will take the matter up for you. It is a legal requirement to have all units tested annually and PIPA covers this requirement. If the school concerned would like further information from ourselves I will happily discuss via telephone or email. The faculty is requiring that the Hire company carries a minimum insurance cover of £2,000,000 unless they can prove that £1,000,000 is the industry standard, which is what most hire companies seem to have. Can you offer any assistance?”Hull University Editors Reply: The first thing to understand is that PLI insurance is not compulsory and therefore there are quite a number of hire companies do not have cover. As the students are supervising themselves then the hire companies insurance will only cover them if they fail to install the unit correctly or if the unit fails in some way during normal use. The Student Union will therefore need to purchase their own PLI cover for the event. There is no set industry standard as to the acceptable level of cover but the majority carry £1,000,000 but there are an increasing number carrying £2,000,000 - £5,000,000 as these are supplying to Local Authorities etc that require these levels. It is far more important that the supervisors understand what is required to supervise safely and the hire company should provide either written or verbal instructions. It is also imperative that the students hire in a unit that is designed specifically to take adults. INPA forwarded copies of our Information Sheet 5, Information Sheet 7 and ETIS 7. Independent Safeguarding Authority The Independent Safeguarding Authority was set up following the introduction of the Safeguarding Vulnerable Groups Act 2006. This act is law and the criteria within it is being organised by the Independent Safeguarding Authority. INPA is extremely grateful to SAFEchild who have agreed to keep readers up to date with developments and how it will affect your businesses. This first article explains the basics. The long awaited Independent Safeguarding Authority (ISA) numbers have been delayed. Again. What does that mean to your business? What is ISA? The ISA has been established to help prevent unsuitable people working, or coming into contact with children, young people, vulnerable adults and /or their families. Why is it being brought in? ISA is being introduced to overcome the lack of portability of CRBs and to introduce continuous monitoring of people working or involved with children, young people, vulnerable adults and/or their families. How does it work? ISA will vet applicants and if cleared to work with vulnerable groups will issue an ISA number. Alternatively applicants will be barred, under which circumstances they would not be issued an ISA number.Importantly, it will be a criminal offence for an employer to fail to check an applicant has an ISA number and an applicant to work without an ISA number Is my business affected? Most businesses in the Inflatable Play and Attractions sector will be affected as they will be defined by ISA as undertaking a “regulated activity” if employees have direct contact with, and supervision of, children or vulnerable adults once a month or more or for three days in a 30-day period. Your business could be defined as undertaking “controlled activity” if it is also involved in support work in adult social care, general health and further education. Employers who provide “regulated” or “controlled” activities will have a legal obligation to refer information if they have dismissed an individual because they have harmed, or may harm, a child, young person or vulnerable adult. It will be an offence not to refer to the ISA. Most businesses will refer their concerns in the normal way to either social care services or the police, both of whom would refer on to the ISA. When will the ISA system be introduced? The ISA system will roll out over a 5-year period starting inJuly 2009 when there will be two new lists of people who will be barred from working with 1;Children and young people and 2; Vulnerable adults 20 inpas.co.uk
Independent Safeguarding Authority FromJuly 2010 all those applying for NEW posts, either voluntary and paid; involving “regulated”activities which involve direct contact or work with children ( or vulnerable adults) can apply to have ISA numbers By November2010 all such new job applicants MUST have an ISA number before beginning work. The roll out will be completed by 2015 when everyone will be expected to have an ISA number. How much will it cost? An ISA will cost £64 for paid staff and will be free for volunteers. An enhanced CRB check will be included within this fee. The ISA Umbrella body you select to process your ISA applications will levy an Administration fee on top of this charge. What do I need to do now? All organisations have a duty of care towards the children, young people and vulnerable adults in their care and you should, as a minimum, have a child protection policy in place, adequate procedures, appropriately trained staff and have CRB checked the relevant staff. 26 inflatednews.co.uk AIMODS UPDATE Advertorial I’ll start by saying that on 5th May 2009 I met with the IPMA and found the meeting to be very informative and my Company, Airquee Ltd will join the IPMA in May. As Chairman of AIMODS I think this will be a tremendous benefit to our members. There are two distinct differences between the two organisations in that the IPMA is a trade-body specifically for Inflatable Manufacturers whereas AIMODS, as the name suggests, is for Manufacturers, Operators, Designers and Suppliers. As business becomes more complicated and competitive I think we’re potentially on the verge of an era that may see greater communication and progression within the industry to drive home the standards that all reputable industry members have been working for. BSEN14960:2006 and PIPA continue to gather momentum in the UK and internationally. Members of the industry who fail to keep abreast of guidelines and standards that impact the design, manufacture, supply and operation of inflatable equipment will come unstuck. AIMODS will be working to ensure its members are aware of all the most up-to-date information and be on-hand to support them should they require anything. With Clive Moss stepping down as CEO of MUTA/PTA, Quintus-the new Secretariat for the association - will be taking over the PIPA scheme’s administration. Their first major project is a Local Authority engagement programme to increase the awareness of PIPA-certified equipment. 28 inflatednews.co.uk PIPA CONCERN OVER LOGO MISUSE Advertorial Stop cowboys taking a free ride on PIPA Now and again in PIPA HQ we get an anonymous call from someone alerting us to an inflatable hire company which is displaying the PIPA logo but does not actually use PIPA-tested equipment. Given the nature of the PIPA scheme, these situations are difficult to deal with. We encourage operators with tested equipment to display the PIPA logo in order to raise awareness of the scheme. However, it is inflatables and not operators that are registered with PIPA. Unfortunately it is easy for operators with no PIPA-tested equipment to acquire a copy of the logo and use it to gain credibility without actually getting their units inspected. Mechanisms are, of course, in place to maintain the integrity of the scheme: any inflatable without a tag is simply not PIPA registered. The status of an inflatable with a tag can be checked online (http://www.pipa.org.uk/findTag.asp) or with PIPA Administration on 0207 340 6265. All you need is the tag number to find out whether the unit is tested or not. Operators with PIPA-tested equipment should be willing to give their tag numbers to prospective clients. If operators refuse, then customers have every right to smell a rat. The extent of this practice will improve as PIPA’s new awareness campaign gathers pace – our focus is currently on increasing recognition of the scheme among local authority event organisers. The name MUTAhas been chosen for the association, as historically this has been its popular name and is the brand that resonates most with the industries that the association represents. MUTA has represented all facets of the technical fabrics, textiles, and temporary structures industry for close to a century. Following a period of consultation with both membership and the leadership council, MUTA is beginning its 90th year with a renewed focus on its largest constituent membership – the marquee and tent industry. The Association continues to fully represent more widely through its manufacturing, coating and specialist supplier members. These changes will make it more effective, more relevant and more efficient. Under its previous guise, the PTA championed standards and technical excellence as well as skills, training and accreditation. 40 inpas.co.uk HSE STATEMENT ON TESTERS SENTENCE News release WM/411/0815th May 2009 HSE SAYS: SAFETY CHECKS ON INFLATABLES MUST BE CARRIED OUT PROPERLY The Health and Safety Executive (HSE) is warning inspectors of inflatable play equipment that they must conduct comprehensive safety checks or face prosecution. In June 2006, safety concerns expressed by Shrewsbury & Atcham Borough Council, regarding the safety of inflatable play devices, sparked HSE’s investigation into the validity of safety certificates and inspections carried out by Peter John Morrell. HSE’s investigation uncovered instances, at Watton in Norfolk, Spennymoor in County Durham and Kingston-on-Thames, where Morrell had issued ‘pass’ certificates for inflatables, despite there being safety-related faults. In November 2008 HSE issued a Prohibition Notice on Peter Morrell legally preventing him from conducting further inspections until he has complied with the ‘Schedule to the Notice’. HSE pursued its investigation of three specific instances in order to bring a prosecution case before the courts. Several deficiencies noted with the inflatables showed that Morrell’s inspections were not carried out in accordance with the relevant BSEN (British & European Standard). This standard is not the law but following it would usually be sufficient to demonstrate compliance with the law. Although Morrell operated as an ‘Inspector of Inflatables’ he was not registered with any of the recognised authorities for the Inspection of Play Inflatables and Amusement Devices (such as PIPA and ADIPS) nor did he demonstrate his competence in any similarly accepted manner. Morrell (74), of Prestatyn, pleaded guilty at Shrewsbury Crown Court on Friday 15th May, 2009, to three charges of breaching section 3(2) of the Health and Safety at Work etc Act 1974. The judge imposed a conditional discharge of 12 months for the breach in the Kingfisher Centre, Kingston-upon-Thames and two years for each of the instances in County Durham and Norfolk. These conditional discharges are to run concurrently and the judge voiced that such serious health and safety breaches, aggravated by the risks to young children, would normally attract a substantial financial penalty but this was “not possible” given the state of Morrell’s personal finances which also reflect his inability to receive remuneration from inspecting inflatables due to the Prohibition Notice served on Morrell by HSE. continued on page 41

The legal onus to arrange regular checking of equipment, by an appropriately qualified body, lies with the operators of that equipment. In addition, anyone issuing safety certificates for unsafe inflatables could be risking the health and safety of young children enjoying a moment of leisure and pleasure. Morrell had certified inflatables as safe for use, when they were not. Disregard for the safety of children is a serious matter and is also an irresponsible attitude that could have endangered others.” Notes to editors: 1. Section 3(2) of the Health and Safety at Work etc Act 1974 states: “It shall be the duty of every self-employed person to conduct his undertaking in such a way as to ensure, so far as is reasonably practicable, that he and other persons (not being his employees) who may be affected thereby are not thereby exposed to risks to their health or safety”. 2. The maximum penalty in the lower court (Magistrates’) for a single breach of Section 3(2) of the HSW Act is £20,000; or up to 1 year imprisonment for any offences committed after 16th January,2009. Cases heard in the higher (Crown) court for offences committed after 16th January,2009 carry an unlimited fine or up to 2 years imprisonment. DREAMSPACE VERDICT Previous issues of Inflated News covered the tragic story of the Dreamspace sculpture that broke free from its moorings at an event in Chester-Le-Street in July 2006. The accident left two visitors dead and a further twenty seven injured Maurice Agis, 77, from Bethnal Green, East London, had been found guilty at Newcastle Crown Court in February of breaching the Health and Safety at Work Act by failing to ensure the safety of members of the public. He was fined £10,000 He was also on trial for the manslaughter by gross negligence of Elizabeth Collings and Claire Furmedge, who fell out of his Dreamspace sculpture in Riverside Park in Chester-le-Street, County Durham. The jury was unable to reach verdicts on manslaughter charges. Also facing sentence was Chester-le-Street Council, which had carried out a safety check before the exhibit was opened to the public. The council pleaded guilty to breaching the Health and Safety at Work Act and was fined £20,000. Events management company Brouhaha International Limited, which was run by Agis's son Giles and was involved in the Dreamspace visit also pleaded guilty to charges under the Health and Safety at Work Act and was fined £4,000.
